By downloading, installing, or using Mode, you agree to these Terms of Service. If you do not agree to these terms, you may not use Mode. These terms govern your use of Mode, a Visual Studio Code extension by Aruna Labs, designed to integrate directly with third-party AI providers using user-supplied API keys.
2. License
Mode is licensed to you, not sold. Subject to your compliance with these Terms of Service, Aruna Labs grants you a non-exclusive, non-transferable, revocable license to use Mode for personal or professional purposes.
Restrictions
You may not:
- Modify, reverse engineer, or create derivative works of Mode.
- Use Mode in a way that violates applicable laws or third-party terms (e.g., OpenAI’s terms of service).
- Reproduce, distribute, or sublicense Mode without prior written consent from Aruna Labs.
3. User Responsibilities
You are responsible for:
- API Keys: Ensuring the proper use of API keys for AI providers, including compliance with their terms of service.
- Data Security: Protecting your own data and credentials when using Mode.
- Legal Compliance: Using Mode in a manner compliant with all applicable laws and organizational policies.
4. Privacy and Data Handling
Mode does not collect, store, or transmit user data. All interactions occur directly between you and the connected third-party AI providers via your API keys. See our Privacy Policy for full details.
5. Third-Party Services
Mode connects to third-party AI providers (e.g., OpenAI, Anthropic) via user-provided API keys. By using these providers:
- You agree to their respective terms of service and privacy policies.
- Aruna Labs is not responsible for the performance, availability, or handling of data by these providers.
- Any disputes or issues with third-party services must be resolved directly with the provider.
6. Limitations of Liability
To the fullest extent permitted by law:
- Mode is provided "as is," with no guarantees or warranties of any kind, including fitness for a particular purpose or uninterrupted operation.
- Aruna Labs is not liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages arising from your use of Mode or third-party services connected through it.
- Aruna Labs is not responsible for errors, bugs, or issues caused by third-party services, such as incorrect outputs from AI models.
7. Indemnification
You agree to indemnify and hold harmless Aruna Labs, its officers, employees, and affiliates from any claims, damages, or liabilities arising from:
- Your use of Mode.
- Your interactions with third-party AI providers through Mode.
- Any violation of these Terms of Service.
8. Updates and Modifications
Aruna Labs reserves the right to update, modify, or discontinue Mode or these Terms of Service at any time without notice. Continued use of Mode after such changes constitutes your acceptance of the updated terms.
9. Termination
Aruna Labs reserves the right to terminate or suspend your access to Mode without notice if you breach these terms or misuse the extension. Upon termination, you must cease all use of Mode and uninstall it from your device.
10. Governing Law
These Terms of Service are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any disputes arising under these terms will be resolved exclusively in the state or federal courts located in California.
11. Disclaimers
- No Guarantees: Aruna Labs does not guarantee the accuracy, completeness, or reliability of results or outputs provided by Mode or the AI providers connected through it.
- Beta Disclaimer: Mode is in early access, and features may change, break, or be removed during development.
